Shareholder Robert A. Rabbat successfully disposed of a wrongful discharge and FLSA lawsuit originally brought by three disgruntled former employees in Nevada state court. The former employees claimed they were forced to terminate their employment because of several alleged regulatory violations they claimed to have observed while employed. After Robert strategically removed the case from state to federal court, the United States District Court for Nevada threw the case out and granted judgment in favor of Robert’s client on all federal claims, adopting Robert’s argument that the entire field of law in the client’s industry was pre-empted by federal statutes and regulations.
